This Privacy Policy (“Policy”) describes Cell Phones For Soldiers (CPFS), use of information regarding the general visitors to CPFS’s website, which shall include the main CPFS website and all other CPFS affiliated webpages (“Website”).

Cell Phones For Soldiers is a 501(C)(3) non-profit corporation with its principal place of business in Austin Texas, respects your privacy and is committed to ensuring that your privacy is protected. It is CPFS’s goal that you fully understand (i) the types of information that CPFS may collect from you or that you may provide to CPFS when you access the CPFS  Website or register for CPFS services, and (ii) CPFS’s practices for collecting, using, maintaining, protecting and disclosing that information.

Please read this Policy carefully. If you do not agree with the terms and conditions in this Policy, do not use or access the Website or CPFS services. By accessing or otherwise using the Website or services provided by CPFS, you acknowledge that you have read and agree with the terms of this Policy. CPFS reserves the right to make edits to this Policy at any point in time without notice. Please check this page from time to time to view the most current Policy. Your continued use of CPFS’s Website means you have read and agreed to the latest version of CPFS’s Policy.

What type of information does Cell Phones For Soldiers (CPFS) collect?

There are two main types of information that CPFS may collect from you: (1) personal information that you provide to CPFS and (2) non-personal information which CPFS may automatically collect from you.

  1. Pursuant to applicable state law and upon obtaining the proper consents (if applicable), as you view, register, and interact with the CPFS Website and/or CPFS services, you may opt to provide CPFS with personal information such as your name, address, phone number, email address, military branch, rank, service dates, date of birth, benefit claims details, financial information, basic physical and mental fitness details and, other information that may be relevant to a particular program or service you are interested in. Please note, some of the information that you provide to CPFS may be considered “sensitive” in nature pursuant to applicable law.

    For more detailed information regarding what information is collected by CPFS when you register or contact CPFS as a veteran or military service member (Alumni), Veteran Support Officers (VSO),and/or Caregiver, or donor, please see below:

    • Alumni/VSOs/Veterans: Pursuant to applicable state law, and upon obtaining the proper consents (if applicable), CPFS will ask you for personally identifiable information, such as name, date of birth, gender, type and location of your injury, and eligibility documentation. This may include your DD214, enlisted record brief or officer record brief, current unit orders to a transition unit or battalion, line of duty documentation. Such information may contain sensitive personal information protected by state and federal laws and regulations such as your signature, social security number.  Once CPFS validates your veteran service, the DD214 is deleted and no longer stored.

      Once you are registered as an Alumni (approved veteran or military member for one of our services), and depending on your level of involvement with CPFS services, CPFS may ask you for additional information. This may include questions about benefits claim(s) details, basic financial information, and other information that may be relevant to the program or service you are interested in.

      Please note, if CPFS is unable to verify the information you provide to CPFS, CPFS may request additional information.
    • Family Support: Pursuant to applicable state law, and upon obtaining proper consents (if applicable), when you register as a Family Support member, CPFS will ask you for personally identifiable information such as, your name, email address, telephone number, and mailing address, as well as other identifying information like date of birth.

      Additionally, CPFS will ask for information about your support, including name, eligibility documentation, and service details, such as branch, rank, and service dates. Requested eligibility documentation may include the warrior’s DD214. Please note, such information may contain sensitive personal information protected by state and federal laws and regulations such as your and/or the CPFS’s signature, social security number.
      Please note, in the event that CPFS is unable to verify the information you provide to CPFS, CPFS may request additional information such as your driver’s license or another form of identification in order to complete the registration process.
    • Donors: During the donation process (when you make a donation to CPFS or sign up to receive emails), CPFS will ask for information that could be used to personally identify you. This includes your contact information, such as your name, mailing address, phone number, and email address. If you donate via credit or debit card, CPFS will also ask for your card number, expiration date, and other information necessary for CPFS’s third party vendor to process the transaction. If you donate via check, CPFS may ask for limited bank information.
    • Minors: CPFS believes that protecting the privacy of children is especially important. CPFS does not knowingly collect, use, or disclose sensitive information about anyone who is under 18 years of age except in special circumstances with parental consent.
  2. CPFS may also automatically collect non-personal information from you such as the below:

    Automatic Information, Collection and Tracking: When you access, use the Website, or register for CPFS, CPFS may use technology to automatically collect:
    • Usage Details. When you access and use the Website, CPFS may automatically collect certain details of your access to and use of the Website, including traffic data, location data, logs, and other communication data and the resources that you access and use on or through the Website.
    • Device Information. If you are accessing the Website on your mobile device, we may collect information about your mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, location, and. Please note when this non-personal information is combined, it may become personal information. However, it is CPFS’s policy to anonymize this information so that all automatic collection and tracking information remains anonymous.

We may use cookies to collect this type of information, as further explained below.

Information Collection and Tracking Technologies: The technologies we use for automatic information collection are as follows:

  • Cookies or mobile cookies: A cookie is a small data file that individual websites store on your computer’s hard drive – if your web browser permits. The Website can later retrieve that cookie to let CPFS know you’ve been to the CPFS Website before, among other things. Cookies typically make your use of the Website easier, make the Website run more smoothly, and help CPFS to maintain a secure Website. Many websites use cookies. CPFS uses both session ID cookies which expire when you close your browser and persistent cookies which remain on your hard drive. You are free to decline CPFS’s cookies if your browser permits, but some parts of the CPFS Website may not work properly if you decline.
  • Web Beacons. Pages of the Website and CPFS emails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit CPFS, for example, to count users who have visited those pages or opened an email and for other related app statistics (for example, recording the popularity of certain app content and verifying system and server integrity).

It is CPFS’s goal that you fully understand how we collect information, how we use that information, and the steps we take to protect that information. CPFS will update this Policy from time to time. Third parties and links to third party websites: CPFS uses third parties such as Google, HostGator, Microsoft/Bing, Meta, Amazon, and Adobe to monitor certain pages of CPFS’s Website for the purpose of reporting web traffic, statistics, advertisement “click-throughs,” and other activities on CPFS’s Website. Where authorized by CPFS, these third parties may use cookies and/or other monitoring technologies to compile statistics about CPFS’s Website visitors.

These third parties may use tracking technologies to collect information about you when you use the Website or CPFS services. The information they collect may be associated with your personal and/or non-personal information about your online activities over time and across different Websites, apps, and other online services Websites. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. CPFS does not control these third parties’ tracking technologies, what is being tracked, or how the information may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. 

The CPFS Website contains links to third party, external websites. This Policy applies only to CPFS’s Website and services. When you leave CPFS’s Website to visit one of these linked sites, the only information transferred to the third party is the fact that you came from CPFS To understand your privacy on other websites, you must read their privacy policies. Some of CPFS’s third-party advertisers and ad servers that place and present advertising on the Website may collect information from you via cookies, web beacons, or similar technologies. These third-party advertisers and ad servers may use the information they collect while you are on CPFS’s Website to help present their advertisements, to help measure and research the advertisements’ effectiveness, or for other purposes. The use and collection of your information by these third-party advertisers and ad servers is governed by the relevant third-party’s privacy policy, which may be different from CPFS’s Policy. CPFS is not responsible or liable for these third-party privacy policies and how your information may be used by the third-party. Additionally, the inclusion of any link to a third-party website does not imply CPFS’s endorsement of the third-party, its website or websites, or the products and services it promotes or sells.

How does CPFS use the information it collects?
  1. CPFS may use your personal and non-personal information in the following ways:
    • Entering your information into our databases for internal recordkeeping, reporting, and data analysis.
    • To communicate with you to obtain your input, provide information about our programs and events, or request contributions (provided you have opted to receive such communications).
    • To improve our programs and services
    • To customize CPFS’s Website according to your interests.
    • To share information with third parties who help us manage CPFS’s Website and databases, and who assist us with our marketing efforts, such as Google Analytics, HostGator, etc.
    • To share information with third parties who help us deliver our programs and services which you register for.
    • To share information with third parties who deliver their own programs and services to veterans and their caregivers.
    • To provide you with any necessary tax information regarding a donation.
    • To share information with third parties who provide goods and services to CPFS (e.g., parties who process donations or help us manage our Website and databases).
    • To share information with third parties to help inform you of other groups you may wish to support.
    • To share information with third parties as required by law, or as part of a legal process.
  2. CPFS may share your information with other people or non-affiliated companies (a) to provide services that you have requested, (b) in other ways described by CPFS when you provide the information, (c) when CPFS has your consent, or (d) under the following circumstances:
    • When CPFS is required to respond to a subpoena, court order or other legal process, or to establish or exercise legal rights or defend against legal claims. 
    • When CPFS believes it necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of the CPFS Terms of Use Agreement, or as otherwise required by law.
  3. CPFS may sell donor contact information, including but not limited to the donor’s name and address, to third-party partners for marketing and promotional purposes. By using the Website and certain features, including our donation feature, you consent to the sale of your contact information as described in this policy. CPFS will never sell your financial information or sensitive personal information. 

CPFS will not sell, disclose, or share data commercially with any third-party organizations.

Does CPFS track my online activity while I’m not on the CPFS site?

Cookies and other technology may be used to track non-personal information about your web-browsing habits. For example, if a significant portion of visitors all browse to the same website immediately after visiting CPFS, we may use this information to improve your experience at CPFS’s Website.

CPFS respects web browser “do not track” signals and other mechanisms that provide you the ability to opt out of having your information or online activities collected. But remember, unless you have selected the “do not track” function in your web browser settings, third parties (not just CPFS) may collect information about your online activities over time and across different websites.

How does CPFS secure my information?

CPFS is committed to online data security and ensuring that your information is secure. CPFS takes steps to make all information received from you online as secure as reasonably possible from unauthorized access and use. CPFS has put in place physical, electronic, and managerial procedures to safeguard and secure the information we collect. Records containing information are stored at secure facilities; CPFS Websites use Secure Sockets Layer (SSL) encryption technology (a tool used to verify the legitimacy of a website); and CPFS employees are provided training on how to treat your data securely.

The safety and security of your information also depends on you. While CPFS strives to protect all information received from you while using the Website, CPFS cannot guarantee the security of any information you transmit to CPFS and others online, and you do so at your own risk. CPFS is not responsible for circumvention of any privacy measures or security measures CPFS provides. How long does CPFS store my information?

The period during which CPFS stores your information varies, depending on the purpose for the processing of the information, including for the purpose of satisfying any legal, regulatory, tax, accounting, or reporting requirements. In all other cases, CPFS stores your information until you request that your information be partially or completed deleted as stated in this Policy. All DD214 forms are deleted, once the application is approved. 

Will  CPFS will contact me?

If you provide CPFS with your contact information, CPFS may provide you with information about CPFS programs and how you can help this generation of veterans. However, if you would not like to receive these messages, you have the right to opt out of having your information used for certain purposes when CPFS asks for your contact information. Information on how to opt out of having your information used for certain purposes is stated below.

International Users

While you may be accessing CPFS’s Website outside of the United States, the Website is controlled, operated and administered by CPFS from its offices in the United States of America.  This Privacy Policy is provided in accordance with and subject to applicable United States law.  If you decide to continue to access the Website and the online services from your location outside the United States, you hereby agree that your use of the Website and related services is subject to this Policy and your information will be transferred or processed in the United States. If you are accessing the Website outside of the United States, you may have additional rights to access the information CPFS collects about you. Your Privacy Rights

Your options About CPFS collection, use, and disclosure of your information.
CPFS is dedicated to providing you with your options when it comes to the information you provide or that CPFS otherwise collect from you when you use the Website or our services. This section describes the mechanisms CPFS provides for you to control certain uses and disclosures of your information:

  • Tracking Technologies: You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you choose to remove cookies or reject cookies, this could affect certain features or services of the CPFS Website.
  • Promotion by CPFS: If you do not want CPFS to use your email address or contact information to promote CPFS products or services, you can opt-out by submitting your request to [email protected]. We do not control third parties’ collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Under some U.S. state laws, to the extent applicable to CPFS as a nonprofit corporation and depending on the jurisdiction in which you live, such as Colorado, Delaware, Maryland, Minnesota, New Jersey, or Oregon, (now or in the future), you may have a right to the following:

  • Right of Access: You may have the right to access your information held by CPFS. You may have a right to ask CPFS for a copy of your information; confirmation as to whether your information is being used by CPFS; details about how and why it is being used; and details of the safeguards in place regarding the transfer of your data.
  • Right to opt out: You may have a right to opt out of having your information collected by CPFS. You may also have a right to require consent to process your sensitive personal information.
  • Right to correction: You may have the right to request that CPFS correct or update any personal information that CPFS has collected from you.
  • Right to deletion: You may have the right to ask CPFS to delete your personal information. You may have a right to ask CPFS for further information on these specific circumstances by contacting CPFS using the details below.
  • Right to restrict use of your information: You may have a right to ask CPFS to restrict the way that CPFS processes your personal information in certain specific circumstances.
  • Right to stop marketing. You may have a right to ask CPFS to stop using your personal information for direct marketing purposes. If you exercise this right, CPFS will stop using your personal information for this purpose.
  • Right to data portability. You may have a right to ask CPFS to provide your information to a third-party provider of services. This right applies only where CPFS uses your information on the basis of your consent or performance of a contract, and where CPFS’s use of your information is carried out by automated means.
  • Right to object. You may have a right to ask CPFS to consider any valid objections you have to CPFS’s use of your personal information where CPFS processes your personal information on the basis of CPF’s or another person’s legitimate interest.
  • Right to revoke consent. You may have the right to revoke your consent to process your personal information.

How do I exercise my rights?

Please note, CPFS is required to verify your identity to process your request and reserves the right to confirm your state residency. CPFS may require you to provide additional information in order to verify your identity. CPFS reserves the right to deny your request if CPFS cannot verify your identity. You may designate an authorized agent to submit your verified request by providing written permission and verifying your identity or through proof of power of attorney.

CPFS will provide a response to your request within 30 calendar days of receiving your request, or provide you a reason for any potential need for an extension period in writing.
